This website is operated by Treatots Market. Throughout the site, the terms "we", "us" and "our" refer to Treatots Market. Treatots Market offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or booking a table stall with us you engage in our "Service" and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions.

Any new features or tools which are added to the current website shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 - STALL BOOKING TERMS

All stall bookings are subject to availability and must be completed and pre-paid online, via a secure booking platform, ahead of the sale date through www.treatotsmarket.co.uk. No stall bookings can be taken in cash on the day at the venue. By completing the booking form and paying the stall booking fee you accept and agree to all Terms and Conditions. All bookings are non-refundable.

Stall holders are permitted to enter the venue one hour before the Treatots Market Sale is due to start, all stalls must be set up before the doors open to the general public. No late arrivals, once the sale has started, will be permitted to set up due to Health and Safety precautions and no refunds can be issued for late arrivals or no shows.

Stall holders are required to take all unsold items, and rubbish from their area within 30 mins from the time the sale finishes. After this time, stall holder may not be permitted to stay on the premises as stall holders will not be insured.

Each stall booking includes a table, choices of either 3ft 0.9m x 0.6m or 4ft approx 1.2m x 0.6m or 6ft approx 1.8 x 0.6m and a chair (subject to availability on the day) and up to 0.8m to the side of the table to display a larger item, such as clothes rail, pram, crib etc. We advise no more than 2 people to man a stall.

Stall holders are responsible for the safety of their own stall. Health and Safety precautions must be adhered on the day of sale and when setting up the stall, to ensure all access, walk ways around the sale and venue fire escapes remain clear at all time, and there are no obstructions or trip hazards that buyers or any other people participating or attending the event may/could injury themselves on.

Once a booking is completed, the stall holder will receive a confirmation email with seller tips attached.

SECTION 2 - GOODS FOR SALE

All stall bookings are for the sell of quality second-hand items only, (unless a business/craft stall, please see Business/Craft Stall Terms).

All children's toys and equipment should be complete, in good condition, fully functional and comply with British Safety Standards. No broken stained items with loose or missing parts. All toys supplied in the UK must meet the requirements of the Toys (Safety) Regulations 2011.The regulations define a toy as 'any product designed or intended, whether or not exclusively, for use in play by children of less than 14 years of age, but excluding those products specified in Schedule 3 [of the regulations]'.

Toys that are second-hand are covered by the General Product Safety Regulations 2005.

The special warnings and instructions are required for both second-hand and new toys.

You are advised to only sell second-hand toys that are CE marked, contain any relevant instructions or warnings and have been checked for any obvious faults.
If any items don't meet the required standards, you may be asked to remove them from the stall and not to sell them at Treatots Market.
It is advisable not to sell car seats, any given involvement in an accident or simply dropping the item can affect the internal structure, even if any damage is not visible on the exterior. If it is not structurally sound, then it will not protect a child. Equally, we would advise against selling second-hand cot mattresses, given the significant link with cot death.

Prams, Buggies and Pushchairs

All prams and pushchairs, both new and used, must comply with British Standard/European Standard 1888: 2012 or British Standard/European Standard EN 1888:2003. If prams and pushchairs have been damaged or modified, they may no longer meet the requirements of the standard.
Cord and Drawstring Risks from Children's Clothing

Safety Recommendations:

Based on the requirements under the European safety standard:

• Clothes for children up to seven years of age should not have cords or drawstrings in the hood and neck area.
• Clothes should not have cords longer than 75mm in the hood and neck area or drawstrings with free ends.
• Cords in the hood and neck area should not be elastic except for shoulder straps and halter necks.
• Clothes for children should not have cords or drawstrings with free ends longer than 140mm in the chest
• and waist area.
• Halter neck-style children's clothes should not have loose ends in the hood and neck area.
• Children's clothes intended to be tied at the front should not have tied belts or sashes longer than 360mm when measured untied from the point where they are to be tied.

Electrical goods

The sale of electrical goods is strictly prohibited at Treatots Market. Sellers of second-hand electrical goods are responsible for ensuring the goods meet legal safety requirements and sellers may be liable to pay compensation if they sell unsafe goods, which then cause injury or damage.
If any items don't meet the required standards, you may be asked to remove them from the stall and not to sell them at Treatots Market.

Business/Craft Stall Terms

All standard booking stall terms apply, the sale of new or hand made goods is regarded to be a Business/Craft Stall. Business/Craft Stalls must adhere to the following terms to trade at Treatots Market:

• Provide a copy of Public Liability Insurance. This is required to be emailed over in advance before the event date, without proof of insurance Business/Craft
stallholders will not be able to set up.
• Trade legally and comply with all business laws business and safety legislations.
• Food stall holders must comply with specific Food Hygiene requirements and hold the relevant certificates and registrations required by a food business.
• All stallholders must ensure that their stall and any displays are set up safely.

SECTION 3 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 4 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Booking charges are subject to change without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service or offers.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any booking you place with us. We may, in our sole discretion, limit or cancel bookings per person, per household or per order. These restrictions may include bookings placed by or under the same customer account, the same credit card, and/or bookings that use the same billing address. In the event that we cancel a booking, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the booking was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate information for all bookings made via our website. You agree to promptly update information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 7 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions.

Treatots Market accepts no responsibility for the condition or quality of goods purchased at a Treatots Market Sale. All purchases are at the buyers own risk, and sold as seen. Treatots Market accepts no liability for damages or losses however caused of buyers' or sellers property. All persons enter the sale at their own risk.

In no case shall Treatots Market be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, damage to goods, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service, or for any other claim related in any way to your use of the service, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

It is agreed within these Terms and Conditions, in the rare case, that due to severe weather conditions the event is not able to take place refunds will not be issued, but a booking transfer will be granted on the next available date.

SECTION 14 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 15 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions).
